Smoglian to stay behind bars
after dropping bail bid

Kangaroo Island gym owner Kenneth Smoglian will remain in prison after he abandoned his bail bid on rape and assault charges.
The Island Independent attended Mr Smoglian’s appearance by video link in the Adelaide Magistrates Court earlier today.
He was due to apply for bail so he could return to live on Kangaroo Island to attend to his personal fitness business that his lawyer claimed was “going into financial decline with him custody”.
Since his last court appearance on 15 July, prosecutors had made contact with the alleged victim to ascertain any safety or personal security concerns she may have were Mr Smoglian to be granted bail.
Having read the report prepared by prosecutors, his lawyer told the court that “given the matters raised” they would no longer be pursuing their application for bail.
Under state law, Mr Smoglian is not precluded from applying for bail again at a later date.
The 39-year-old American River man, known locally as "Smogdog", has yet to plead to one count each of assault, indecent assault and engaging in sexual intercourse without consent.
The former boxer, originally from Melbourne, opened popular Kingscote gym Island Fitness in 2021. The premises closed its doors earlier this month.
The state’s chief magistrate Judge Mary-Louise Hribal noted Mr Smoglian had withdrawn his bail application.
She remanded him in custody to face court again in October.
